This document explains the Terms and Conditions applicable to the use of our website www.keralasaree.com.
Please read the contents carefully every time you use our website to purchase any products.
The information and personal details that you provide us shall be deemed correct and corresponding to reality.
www.keralasaree.com grants you limited permission to access and use this site for personal use but not to download or modify any part of it. Limited permission does not allow any commercial use of this site or its contents, any data gathering, downloading or copying of account information for the benefit of another merchant.
No portion of this site (including images, text, form or page layout) may be copied, duplicated, reproduced, sold, visited or otherwise exploited for commercial purposes without the express written consent of www.keralasaree.com.
You may not use the "keralasaree" red peacock logo which is our trademark graphic without our express written consent.
Please note that any unauthorized use of this site terminates the permission granted by www.keralasaree.com without prejudice to any other remedy provided by applicable law or these Terms & Conditions.
By visiting our site www.keralasaree.com you consent to receive communications from us electronically; through emails or posting notices on this site.
It is our policy to decline unsolicited suggestions and ideas. However, any such ideas, suggestions, inquiries, feedback, or information you may provide us will be treated as non-confidential and non-proprietary.
All text, images, digital downloads, compilations, icons, logos, software and graphics on this site are the property of www.keralasaree.com.
We have a registered trademark for the exclusive use of the "red peacock logo" on all our labels, signage, stationery, advertisements. This logo is now associated with products of www.keralasaree.com.
Any unauthorized or illegal use of our trademark will be liable for legal action.
Delivery service for products offered on this website is available in India only.
(including its Union Territories)
All our products are shipped door to door from our warehouse in Kerala & Tamilnadu to your provided shipping address via courier.
Processing an order normally takes 2 working days and shipping takes 4-7 Working days.
Free Shipping is only available in India (Zone In-Reach).
The term Working Days does not include National holidays, Sundays or Bank Holidays.
There may also be delays for reasons such as the occurrence of unforeseen circumstances or the delivery zone.
(Refer 'Force Majeure' mentioned in a later clause)
You may track your package at any given point in time, through the Tracking Facility with the help of your Tracking Number.
Our courier service will attempt delivery 2 times at the delivery address provided by you in the order. If the package is not deliverable, it will be returned to the Head Office Warehouse in Kerala.
If the order cannot be delivered due to reasons not attributable to us, we shall consider the order as Terminated and refund the amount within 30 days of the Termination of the order.
We use third-party service for shipping our orders, they provide service in almost all the PIN Code. Unfortunately, there is some area which is ODZ(Out of Delivery Zone), in such case, we will inform you within 2 working days about it, you have the option to cancel the order and get a refund or give us a different address which is in our reach or pay the extra shipping charges to our shipping provider (in this case Fed-Ex).
We try to keep every item displayed on our website, in ready stock. However, if we realize that an item purchased by you is unavailable, we will notify you within 2 working days of your purchase.
You will also be given the option to either continue with the purchase and get a new delivery date or to cancel the order with a full reimbursement of the amount paid within 30 days.
PRICING AND PAYMENT
The prices on our website include GST (Goods & Service Tax) unless otherwise specified.
Shipping is free of cost.
All prices will be mentioned on our website and presumed correct, except in the case of an obvious error.
If such an error is discovered, we will inform you within 2 working days and give you the option of confirming or cancelling your order.
If you choose to cancel, we will refund the amount due within 15 days of cancellation.
However, if you choose to continue with the order at the correct price we will send you a revised invoice to pay the difference amount.
Please note we are not obliged to provide you with any product at the incorrect/lower price if the error is an obvious one and could have been reasonably recognized by you.
Once you have completed your purchases, follow the payment process and verify the information requested.
Before final payment, you can modify the details of your order at any given time.
You may only use debit or credit cards ( Visa & MasterCard ) and PayPal for online payments.
To minimize the risk of non-authorized access your credit/debit card details will be encrypted to allow due and payable payment immediately at the time of placing your order.
When you click "Authorize Payment", you are hereby confirming that the credit card is yours.
Credit/debit cards are subject to verification and authorization by the card issuing authority.
If for some reason the payment is not authorized, we shall not be liable for any failure or delay to deliver and will consider the Order as cancelled.
COD (Cash on delivery) is not available.
We do accept American Express cards however do not accept Bank cheques.
An Electronic copy will be emailed to you when the order is confirmed.
The Members Checkout feature makes it easier to shop on this website.
This option is available when you register as a member.
You will not be required to enter shipping, billing and payment details every time you choose to make a purchase.
This way your card details, number, holder name, the expiry date will be saved exactly as it appears on the card. We will not save your CVV/Security Code.
If you save information of more than one card, the one most recently saved will be considered your Favorite Card and that will be charged by default, for purchases on Members Checkout.
EXCHANGE / RETURN POLICY
We are very careful with our Quality Control before dispatching an order hence we do not accept returns at www.keralasaree.com. However, in the unlikely event that you receive a product which is damaged/defective or in the wrong style or size from the one ordered, you may return the product to our Head Office in Kerala. In such an event, kindly inform us of the problem by email within 48 hours of receipt. Please ensure the returned merchandise is unused and has the original packaging, price tag.
Write to us in 48hrs of receiving the order and we will confirm pickup for the exchange within 48hrs of receiving your request email.
Furthermore, please make sure to reference our size guide when selecting your size as all our size guides are well detailed and product-specific.
You may exchange items for size only once as we cannot bear the onus of size exchanges multiple times for the same product. Also note, size exchanges can only be processed if we have available stock in your required size. Courier charges for return will be borne by us.
Venus Women Private Limited reserves the right to inspect a returned product before processing the refund.
The amount to be refunded will be done through the same online mode of payment that it was originally made, within 15 days of the request being verified and subject to the issuing bank's policy.
If a customer denies receiving an order and we receive the order back with its original packaging, price tag and Invoice, a refund will be issued after deducting a processing and shipping charges of INR 200/-.
Order can be cancelled only before it is processed, customers need to email us firstname.lastname@example.org for placing a cancellation request and www.keralasaree.com reserve all the rights to refuse to cancel an order if the order is processed. We will get back to you in 2 working days of receiving the request.
During the sale period, the exchange for style/size/colour strictly depends on the availability of the stock as we experience high volumes in orders.
However, we reserve the right to cancel an order on account of non-availability of stock in such case customer will be informed within 2 working days of placing the order. If the order is pre-paid the amount will be refunded to the same account from the payment was made.
PRODUCT PROPERTIES / WASH CARE/ SIZING
Our products are made and handled by human hands involving various processes.
There are bound to be variations in color, finish and overall look.
The colors you see on our website will depend on the accuracy of your monitor for which subtle variations must be acknowledged.
Wash care instructions are on all the labels stitched inside the garments as well as displayed on our website.
These wash / dry clean instructions must be followed very carefully.
Each garment is draped and fitted differently. The fit depends on the cut, fabric and styling of each garment.
Some will be fitted and some more relaxed. Our Sizing guide will help you make a decision based on your body size.
You agree to defend, indemnify and hold Kerala Saree, its Directors, employees, shareholders and affiliates harmless from any and all claims, damages, costs and expenses, including attorney fees arising from or related to your use of this site.
By visiting www.keralasaree.com. you agree that the laws of India, under the jurisdiction of the Ernakulam High Court, without regard to principles of conflict laws, will govern these Conditions of Use and any dispute of any sort arising between you and Kerala Saree Boutique or its affiliates.
Any dispute relating to purchase through www.keralasaree.com shall be submitted to confidential arbitration in Ottapalam, Kerala, India.
Kerala Saree Boutique may seek injunctive or other appropriate relief from any court in India and you hereby consent to the exclusive jurisdiction and the venue in such courts.
Arbitration under this agreement shall be conducted under the rules then prevailing under the Indian Arbitration Act.
The arbitrator award shall be binding and may be entered as a judgment in any court of competent jurisdiction.
This site is provided by www.keralasaree.com on an "as is" and "as available" basis.
Kerala Saree Boutique makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials or products included on this site.
You hereby expressly agree that your use of this site is at your sole risk.
To the full extent permissible by applicable law, www.keralasaree.com disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
Kerala Saree Boutique does not warrant that this site, its servers or email sent from www.keralasaree.com, are free of viruses or other harmful components.
www.keralasaree.com will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive and consequential. damages.
While we try and ensure that the details, descriptions and prices of products displayed on the website are accurate, errors may occur. We, therefore, reserve the right to correct such errors, inaccuracies or omissions and to change or update information at any time without giving prior notice of the same.
We also reserve the right to refuse to fulfil any order that you may place based on such erroneous, inaccurate or out-of-date information regarding pricing, shipping, payment or return policies.
To the maximum extent permitted by applicable law, www.keralasaree.com assumes no liability or responsibility for (i) any errors, mistakes or inaccuracies of the content displayed on the website (ii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein (iv) any interruption or cessation of transmission to or from the website and/or (v) any bugs, viruses or the like that may be transmitted to or through our website by any third party.
EVENTS BEYOND OUR CONTROL
We will not be liable for any non-compliance or delay in compliance with any of the obligations we assume under a Contract when caused by events that are beyond our reasonable control (Force Majeure).
Force Majeure shall include any act, event, failure to exercise, omission or accident that is beyond our reasonable control including among others, the following :
i. Strike, lockout or other forms of protest
ii. Civil unrest, revolt, invasion, terrorist attack, terrorist threat, war (declared or not) or threat or preparation of war.
iii. Fire, explosion, storm, flood, earthquake, collapse, endemic, pandemic or any other natural disaster
iv.Inability to use trains, ships, aircraft, motorized transport or other means of transport, public or private
v. Inability to use public or private telecommunication systems.
vi. Acts, decrees, legislation, regulations or restrictions of any government or public authority
vii. Strike, failure or accident in maritime or river transport, postal transport or any other type of transport.
It shall be understood that our obligations deriving from Contracts are suspended during the period in which Force Majeure remains ineffective and we will be given an extension of the period in which to fulfil these obligations by an amount of time equal to the time that the situation of Force Majeure lasted.
We will provide all reasonable resources to end the situation Force Majeure or to find a solution that enables us to fulfil our obligations by virtue of the Contract, despite the situation of Force Majeure.
